iMEGA Can Appeal

Though iMEGA (the Interactive Media Entertainment and Gaming Association) lost in essence the court case against the Department of Justice regarding UIGEA (the Unlawful Internet Gambling Enforcement Act), the Judge granted the Association sufficient credibility and reputation for appellation. On this cause for the online gambling industry, the presiding Judge was Judge Mary L. Cooper of New Jersey District. She ruled that whereas the courts couldn’t change legislation that Congress passed legitimately, iMEGA could appeal to an appeals court in order to question the constitutionality of the UIGEA.

The Department of Justice disputed the cause insisting on that the ban on gambling transactions from online casinos and the UIGEA didn’t yet come fully into force (these regulations are under deep scrutiny at the moment), thus iMEGA really had a base to request the appeal court to suspend the authority of the Act.

iMEGA had some key concerns against the ban on casinos gambling and the UIGEA in the Associations cause, the major ones against the Department of Justice, regarding the Act legitimacy were decided in favour of the government. Mary L. Cooper, the Judge, commented as her court couldn’t pass a ruling on lawful constitutional acts, claims about the fact that the Unlawful Internet Gambling Enforcement Act blocks Free Speech’ right are actually invalid. She added that the financial transfer acceptance isn’t speech. Since the UIGEA doesn’t impact expression, it’s not outside the scope of the First Amendment purview.

However even having this comment, iMEGA can take another step with this online gambling issue farther – to the appeals court of the USA.
