iMEGA Attacks Kentucky

While many in the online gambling community are waiting for the results of the Kentucky seizure case, Interactive Media Entertainment and Gaming Association has started to resist an attack instead. iMEGA’s headquarters is in Washington, DC, and they are fighting Kentucky’s Governor, Steve Beshear on the front lines of the struggle. Last week the company filed a writ of mandamus asking the State’s Court of Appeals to cancel the ruling of Judge Wingate.

We would remind you that in the middle of October 141 online gambling domains were seized by court decision, and the sites’ activity was blocked by the state. iMEGA requested the Appeals Court to interfere in the case and Ed Leyden, iMEGA’s President, decided not to wait for a final decision. Leyden said that the seizure hearing would have become the death penalty. The damage was already done and the harm was irreparable. The case mustn’t have gone as far as it did.

17 November 2008 was the first day of the final forfeiture hearing, however, because of the economy crisis it was postponed till December 3. Joe Brennan, Chairman and CEO of iMEGA, issued a press release where he stated that the lower court disregarded Kentucky law as it had used an old obsolete law to justify the capture of the domain names. There is a newer registered law that has made iMEGA feel that they had to go to the Court of Appeals.

According to the Commerce Clause of the US Constitution, only Congress can regulate commerce with other nations. At the point, Kentucky is stepping over their borders by trying to seize the domains.

New Law against E-Gambling Advertisement

The UK’s Advertising Standards Authority (ASA) has recently announced that one more ad is banned from the UK mass media. The ASA’s criterion of “appropriateness” seems rather specific and this is not the first ad which has been forbidden. The ASA regularly bans some add which doesn’t comply with its standards and the problem is online casinos which play for this add rather seldom agree with these decisions proclaiming that the contest is questionable in accordance with the UK advertising position. This strange situation shows us that ASA has very specific criterions and can interpret the same situations in different ways, so it is a real good luck to understand the reasons of one or other decision.

The most likely answer to the reason of this global misunderstanding because of the very stringent advertising codes is the fact that the age of the codes is definitely small: they have been approved just the last year. The advertising organizations now try to help to the online casinos and the gambling industry as a whole to understand better the fact of the matter. The internet gambling sites probably will succeed in choosing appropriate advertising campaigns when understand better the advertising codes and all the prohibitions.

Some of the ASA’s guidelines are hardly clear to the general public, they are written in laymen’s terms. All the companies involving in the marketing process, including gambling sites and publicity agents will have to understand what is appropriate for the UK audience and what imply unfavorable habits according to the new law.

Online Casinos Not Going to Suffer From Crisis

According to Warwick Bartlett, the Chief Executive for Global Betting and Gaming Consultants, predictions concerning the world’s online casino gambling industry are still worth. Bartlett adhered to his last year’s predictions that said that the world’s online gambling industry would keep on growing hugely the next five years. At the moment those online casinos that are in the parts of the world suffering from an economic crisis have doubted these figures but Bartlett persists in his opinion and keeps saying that the global online industry is going sturdy and will really benefit from the rise in fuel and food price.

The matter is that players do not really want to go anywhere from their homes due to the rising costs on from a gallon of milk to a tank of gasoline…but at the same time the same players do not want to give up their playing habit and rush to the world’s online casinos for gambling. Now all the world’s paper are talking about the crisis in the US economy but it seems that the EU and United Kingdom are going to have the same problems and may enter a recession in the following months.

The state of the American economy has no great affect on the internet gambling companies anymore as so many of the main players have completely or partially withdrawn from the industry. The slowing European economy is a cause for concern, but not actually. Warwick insists that the EU players will go on registering and that online gambling companies with multifarious interests will still benefit from an increasing Eastern European industry.

Gambling Industry Expecting the Changes

The forthcoming presidential election in the US is considered by the online gambling industry as one of the greatest chances that the industry has in order to overturn the very controversial Unlawful Internet Gambling Enforcement Act. After the UIGEA had been passed in 2006, the United States have received a huge number of problems concerning international relationships with countries like Antigua and the 27 member states forming a part of the European Union.

The Bush Administration stands behind the online gambling ban and has to permit various revisions to the questionable legislations in spite of requests from the US financial establishments. So, the gambling community is pinning the hopes on an administration change in the US and predicts that, if Barack Obama is elected, he is the most likely to change an existing online gambling legislation.

As the election is coming nearer, many in the internet casino gambling industry have analyzed carefully election policies of both candidates, in other words they have made an analysis of the Republican and Democratic platforms, candidates’ statements, and other things.

In accordance with the analysis results, Anthony Cabot, Las Vegas lawyer, has concluded that Obama is likely to be the better vote, at least from the point of view of supporting the internet casinos. The UIGEA considers online gambling at the online casinos illegal and whilst not punishing the American gamblers, the current drafting of the legislation places the burden of implementation directly on the shoulders of the banking industry of the United States.

Duplicate Poker Close down Its Doors

The online casino gambling industry of the United States has been a resourceful business since the Federal Government of the US passed the disputable UIGEA. The Unlawful Internet Gambling Enforcement Act prohibited foreign internet casinos from accessing American players and imposed large fines on any company that violates this. The majority of the main world’s online gambling companies withdrew from the US online gambling industry; some others stayed behind and have continued offering a gambling in spite of the possible consequences. Other gambling websites nevertheless, such as Duplicate Poker.com, could manage to offer a modified form of poker gambling and circumvented the US restrictions from removing the element of chance from poker.

Duplicate Poker was able to provide players with a wide range of payment methods and managed even to promote its gambling services in the states which ban online poker. Duplicate Poker was a swift success during the past year for players who did not want to submit to process transactions at the internet casinos and instead of that they rushed to Duplicate Poker.

Last week, on October 5, Duplicate Poker.com shut its virtual doors to its internet casino poker players, saying that the world’s financial crisis is a main reason why the company could not stay afloat. And whereas it was not a big surprise to many in the gambling industry that have watched the finances of the company, it is an outstanding example of the negative affect that the economy is having on the online casino gambling industry.

Battle for Domain Names continuing

Someone may think that it is ridiculous that Kentucky wants to confiscate over 140 gambling domain names. Confiscating the domains of online world’s business operations, the majority of which are based outside of the United States, just seems impossible.

Poker Players Alliance, the Interactive Media Entertainment and Gaming Association and Bluegrass Institute hope to prevent this event. A recent decision of Thomas Wingate, Franklin County Circuit Judge, gives Kentucky the power to seize the gambling domain names based on the idea that they provide illegal gambling services.

Formally, there has not been a court ruling on the issue just yet. The above-mentioned decision of Judge Wingate allows a temporary confiscation of the domain names that State representatives have agreed to forbear from closing the domains conducting negotiations with lawyers of the domain owners. A hearing for this is set on coming Tuesday; it will be exciting to see what the opposing sides have prepared for it.

Beshear, the State of Kentucky Governor, wants to stop the online betting industry and regardless of the fact if you are for online gambling or not, it is hard to disagree that it is bad public policy. Taking into consideration that Kentucky runs lottery that allows bettors to buy second-chance tickets through the web, the online casino gambling and poker persecution is truly hypocritical.

The fact that Governor Beshear thinks all the betting activity at internet-based casinos and poker rooms can generate millions in revenue for the State seems more ironic. Most people are sure that it is their fundamental right to decide on their own to gamble online or not.
